By booking or undertaking training, you confirm that you have read, understood and accepted these Terms & Conditions.
DRIVING INSTRUCTOR TRAINING – TERMS & CONDITIONS
1. Training Appointments
All training sessions are booked by mutual agreement between the trainer and trainee. Once a session has been agreed, that time is reserved specifically for the trainee.
The trainee is responsible for ensuring they are available and ready to attend at the agreed time.
2. Cancellation and Rearrangement
Training sessions cancelled or rearranged with at least 48 hours’ notice will normally be rescheduled without charge.
Where a session is cancelled or rearranged with less than 48 hours’ notice, the trainer reserves the right to charge the full session fee.
3. Late Cancellation
A cancellation made within 24 hours of the scheduled appointment will normally incur 100% of the agreed training fee.
Cancellations made between 24 and 48 hours before the appointment may incur 50% of the agreed training fee, at the trainer’s discretion.
4. Failure to Attend
If the trainee fails to attend a scheduled training session without providing prior notice, the session will be treated as a cancellation and the full training fee will be payable.
Where the trainer has travelled to an agreed meeting point and the trainee does not attend, the full session fee will remain payable.
5. Lateness
Trainees are expected to arrive on time for all training sessions.
If a trainee is late, the session will normally finish at the originally agreed time. The trainer is not obliged to extend the session to compensate for time lost as a result of the trainee’s lateness.
6. Emergencies and Exceptional Circumstances
The trainer recognises that genuine emergencies and unforeseen circumstances can occur.
Where a trainee is unable to attend due to circumstances genuinely beyond their reasonable control, the trainer may, at their discretion, waive or reduce any cancellation charge.
7. Cancellation by the Trainer
If the trainer needs to cancel or rearrange a training session, reasonable notice will be provided wherever possible.
The trainee will not be charged for a session cancelled by the trainer and will be offered an alternative appointment.
8. Payment
Training fees must be paid in accordance with the payment arrangements agreed at the time of booking.
Any applicable cancellation charge will become payable in the same manner as the normal training fee.
The trainer reserves the right to suspend further training where outstanding fees remain unpaid.
9. Maintaining Contact and Six-Month Course Closure
It is the trainee’s responsibility to maintain regular and reasonable contact with the trainer throughout their training programme.
The trainer may contact the trainee from time to time to request that further training sessions are arranged or conducted. The trainee is responsible for responding to such contact and keeping the trainer informed of their availability and intentions regarding their training.
Where the trainer has contacted the trainee requesting that training sessions be arranged or conducted, and the trainee does not respond or make contact with the trainer for a continuous period of six months, the trainer reserves the right to consider the training programme cancelled and closed.
The six-month period applies regardless of whether the lack of contact is initiated by the trainee or results from the trainee failing to respond to attempts by the trainer to make contact.
Medical Circumstances
Where a trainee has stopped or suspended their training due to medical reasons, and this has been communicated to the trainer, the six-month course closure provision may be treated differently.
If the trainee is unable to resume training after the six-month period due to their medical circumstances, the trainer may, at their discretion, offer a credit note for the value of any unused training remaining on the trainee’s account.
The credit note will be for training only and will not be exchangeable for cash or a cash refund, unless otherwise required by law. The credit note may be subject to the trainer’s availability and the terms applicable at the time the training is resumed.
The trainee remains responsible for keeping the trainer reasonably informed of their circumstances and intentions to return to training.
Where no contact is received from the trainee for six months or more, and the trainer has no information indicating that the trainee’s lack of contact is due to medical circumstances, the normal six-month course closure provisions will apply.
10. Course Closure and Refunds
Where a training programme is cancelled and closed under the normal six-month provision, no refund will be offered for any unused training, payments or course fees, except where a refund is required by law.
If the trainee wishes to recommence training after the course has been cancelled and closed, this will be subject to the trainer’s availability and may require a new booking or training agreement. Training fees applicable at the time of recommencement may apply.
11. Booking and Acceptance
By booking a training session or purchasing a training package, the trainee confirms that they have had the opportunity to read, understand and accept these Terms & Conditions.
These Terms & Conditions apply to all training sessions and training packages unless otherwise agreed in writing by the trainer before the booking is made.
12. Changes to Terms & Conditions
The trainer reserves the right to make reasonable changes to these Terms & Conditions where necessary.
Any significant changes affecting existing trainees will be communicated before the changes are applied to future training arrangements.
13. General
Nothing in these Terms & Conditions is intended to remove or restrict any legal rights the trainee may have under applicable UK consumer law.
Where any provision of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
By booking training, the trainee acknowledges that they have read, understood and agreed to these Terms & Conditions.
